Patents and trademarks are core assets of any company and are often at the center of legal disputes. Not every alleged infringer is willing to respect the rights of a patent or trademark owner under a licensing agreement – and sometimes for good reasons.

Our Services

DTS advises and represents clients at every stage of litigation proceedings – from pre-litigation strategy and out-of-court negotiations to litigation support, parallel opposition and nullity proceedings, the enforcement of judgments, and settlement negotiations.

We act before general courts (Regional Courts, Higher Regional Courts, Federal Court of Justice) as well as specialized bodies, including the Federal Patent Court, the Opposition Divisions of the German Patent and Trademark Office, and the Directorates-General 2 and 3 of the European Patent Office.

Our key areas of practice include:

  • Patent infringement proceedings before Regional and Higher Regional Courts
  • Nullity actions before the Federal Patent Court and the Federal Court of Justice, as well as opposition proceedings, particularly before the European Patent Office
  • Trademark infringement proceedings before Regional and Higher Regional Courts
  • Design proceedings before Regional and Higher Regional Courts

DTS is particularly active before the patent dispute chambers in Munich, Mannheim, and Düsseldorf.
