Relevant professional regulations

Insofar as our attorneys have multiple licenses, the respective professional regulations apply cumulatively.

Our German attorneys at law are subject to the Federal Code for Lawyers (BRAO), the Rules of Professional Practice for Lawyers (BORA), the Specialist Lawyers Code of Conduct (FAO) and the Act on the Remuneration of Lawyers (RVG), as well as the Code of Conduct for European Lawyers (CCBE Rules of Professional Conduct). You can view and access all of these regulations on the website of the German Federal Bar Association (BRAK).

Our German patent attorneys are subject to the Patent Attorneys Act (PAO) and the Patent Attorneys Code of Conduct (BOPA), which you can view and access on the website of the German Chamber of Patent Attorneys (PAK), as well as the Code of Conduct of the International Federation of Intellectual Property Attorneys (FICPI), which can be viewed and downloaded from the FICPI website.

Our European Patent Attorneys are subject to the Code of Professional Conduct of the Institute of Professional Representatives before the EPO, which can be viewed and downloaded from the epi website.

Our European Patent Litigators (UPC) are subject to the Code of Conduct for Professional Representatives pursuant to Rule 290.

Insofar as our patent attorneys are (also) patent attorneys in other countries, they are also subject to the respective national regulations.

Out-of-court dispute resolution

In the event of disputes between German attorneys at law and their clients, it is possible, upon request, to seek out-of-court dispute resolution at the regional bar associations (in accordance with § 73 (2) No. 3 in conjunction with § 73 (5) BRAO) or at the Conciliation Board of the Bar (pursuant to Section 191(f) BRAO) at the Federal Bar Association, which can be found on the Internet at: https://www.schlichtungsstelle-der-rechtsanwaltschaft.de/

In the event of disputes between German patent attorneys and their clients, it is possible to apply for out-of-court dispute resolution at the Chamber of Patent Attorneys (pursuant to Section 69 (2) No. 3 in conjunction with Section 69 (5) PAO), http://www.patentanwalt.de
